It sounds to me like the backup software may have gotten smarter and will automatically use the most recent snapshot if it can?t create one itself.
I would think this is on the Netapp side, not the software. Could confirm by enabling NDMP logs and checking, but I just tried it with 'dump'.
You can run 'dump' on a RW volume and it will create a 'backup' snapshot immediately, and remove when dump is done.
I ran it on a VSM target and the dump ran, but just like mentioned earlier, it started using the most recent snapshot rather than creating a new one for itself.
