The current disks are NSE disks but unit is currently not licensed or configured for encryption.

All disks have to be NSE within an HA pair in cDOT. No mixing of NSE and non-NSE disks in an HA pair.
So, for example, you could have a 8020 pair with all NSE drives, and an 8040 pair with non-NSE drives, in a four node cluster.
